Please be aware that your use of this site constitutes your acceptance of these terms and conditions.   These terms apply at all times and may be changed without notice at the sole discretion of Insco Insurance Services, Inc., underwriting manager for Builder's Insurance Services, LLC ("BIS").   By accessing the site, you indicate your acknowledgment and acceptance of and agree to abide by these terms and conditions of use.
  1. Laws and Regulations

    User access to and use of the site is subject to all applicable international, federal, state and local laws and regulations.
  2. Licensing Restrictions

    By posting information on this site, BIS in no way is soliciting or attempting to do any business in geographic areas in which BIS, or any members of the Insco group, are not licensed.   To determine if a particular entity is licensed in your jurisdiction, please click here.   3. Copyright/Trade Marks and Limitations on Use

    The trade marks, logos and service marks ("marks") displayed on the site are the property of BIS.   The information available through BIS and the way it is presented is the property of BIS or its licensors and is protected by copyright, or other intellectual property laws and associated common law principles.   This protection extends to all areas of the site. Further, users are prohibited from using any marks for any purpose including, but not limited to, use as metatags or other pages or sites on the worldwide web without the written permission of BIS or such third party as may own the marks.   Users are also prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works, or using any content or information available on or through the site for commercial or public purposes without the prior written consent of BIS.

    Permission to use the documents from this website is strictly limited to transactions, submissions to, or promotion activities directly involving members of Builder's Insurance Services.   In no event shall any member of Builder's Insurance Services, its operating companies, affiliates, service providers, directors, officers, employees, agents, predecessors or successors be liable for any damages, including special, indirect or consequential damages arising out of or in connection with the use of information or documents available from this website, whether in contract, tort or otherwise, and each member of Builder's Insurance Services specifically disclaims any liability.
  4. No Warranties

    All content on the site is provided to you on an "as is" and "as available" basis without warranty of any kind either express or implied including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose, title non-infringement, security or accuracy.   BIS does not warrant that this site will be uninterrupted or error free.   BIS does not endorse and is not responsible for the accuracy or liability of any opinion, advice or statement made through the site by any party other than BIS.   Other than as required under applicable consumer protection law.   Under no circumstances will BIS be liable for any loss or damage caused by a user’s reliance on information obtained through the site.   It is the responsibility of the user to evaluate the accuracy, completeness, or usefulness of any opinion, advice or other content available through the site.   The user is advised to seek the advice of professionals, as appropriate, regarding the evaluation of any specific opinion, advice or other content.

    The links displayed on this site may transfer the user to the website of a third party.   This is provided solely as a convenience to you and the inclusion of any link does not imply endorsement by BIS of the third party site.   By linking to such third party site, you shall review and agree to that site’s rules of use before using such site.   You also agree that BIS has no control over the content of that site and cannot assume any responsibility for material created or published by such third party sites, including, but not limited to, the potential for viruses or other harmful data which may affect your data or computer.   BIS also prohibits caching, unauthorized hypertext links to the site and the framing of any content available through the site.   BIS reserves the right to disable any unauthorized links or frames and specifically disclaims any responsibility for the content available on any other internet sites linked to this site.   Access to any other internet sites linked to the site is at the user’s own risk.
  6. User of "Cookie" File Features

    Like many other commercial web sites, the BIS web site utilizes a standard technology called a "Cookie" to collect information about how our site is used.   BIS reserves the right to store information on a user’s computer in the form of a "Cookie" or similar file for the purposes of modifying the site to reflect users’ preferences and to otherwise assist BIS in its business efforts.   This is a standard and traditional use of Cookies.
  7. Access to Password Protected/Secure Areas

    Access to and use of password protected and/or secured areas of this site is restricted to authorized users only.   Unauthorized individuals attempting to access these areas of the site may be subject to legal action.
  8. Submission of Information

    By submitting the information to any of our servers, or by linking to third party sites, you agree that (1) the material will not contain any item that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically, sexually or otherwise objectionable material of any kind including, but not limited to, any material which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law; (2) you will use reasonable efforts to scan and remove any viruses or other contaminating or destructive features before submitting any information; (3) you own the information or have the unlimited right to provide it to us and BIS may publish and/or incorporate it into any concepts described in it in our products without accountability or liability; and (4) you agree not to take any action against us in relation to information that you submit and you agree to indemnify us if any third party takes any action against us in relation to the material you submit.   BIS does not and cannot review the content posted by users on the site and is not responsible for any such content.   However, BIS may at any time at its sole discretion remove any content posted by users.
  9. Digital Security and Technology

    Protecting our users’ privacy is extremely important to us at BIS.   In order to access your account information, you will need a browser with a 128-bit encryption, which provides a very strong level of security.   BIS has designed the site to be as secure as reasonably possible given current internet and encryption technology.   However, by accessing this site and using the BIS system, you assume all associated risks and responsibilities.   BIS cannot and does not in any way guaranty that the information submitted to it can be confidential during the submission process.

    BIS uses secure browsers which utilize Secure Sockets Layer ("SSL") technology to communicate with its servers.   This is a protocol designed by Netscape Communications Corporation to provide secure communications on the internet.   You can check to make sure you are in a secure site by the web address which will appear as "https://www." The "s" at the end of "http" means that you have accessed a secure server.   Also, if you are using Netscape 4.0, Microsoft 3.0 or higher, you can check for the picture of a lock in the lower right hand corner of your browser’s application window.   If a lock is closed you are, in fact, in a secure area. For Netscape 3.0, look for a solid key in the same area.

    SSL was primarily designed to:

    1. Create a secure communication channel by encrypting all communications between you and the server.
    2. Authenticate that the server to which you have connected is the one it purports to be.
    3. Conduct a cryptographic word count to ensure data integrity between the server and you. The word count is further encrypted so that it cannot be modified.

    BIS does not engage in the practice of selling our customer information to third parties.   However, it may be necessary from time to time in order to provide better service to request such information as your name, address, e-mail address, telephone number, account number, etc.   We may use this information to respond to your requests, to contact you via e-mail to inform you of new services, or otherwise to better assist in the service of your accounts.

    BIS shall retain the right to not issue a password if, in BIS’s sole discretion, BIS determines that any of the information in the application has changed or is otherwise inaccurate.   Additionally, you are required to inform BIS if a password should be deleted such as when an employee with knowledge of a password leaves your organization.   However, BIS cannot absolutely guarantee and does not guarantee that any information transmitted over the internet or accessed through this site is absolutely secure.   Thus, BIS specifically disclaims any liability for damages, whether based in contract, tort, strict liability or otherwise, including but not limited to any direct, indirect, incidental, consequential or special damages arising out of or in any way connected with access to or use of this site.

    In order to further protect your privacy, you should never reveal your password to anyone.   You should not write it down where anyone can find it or figure out what it is.   You should be sure that you do not use common words that can be found in a dictionary or numbers in a series.   You should also never access this site from a computer to which anyone you do not trust has access.

    Internal access to customer data is limited to those who specifically need access to conduct their business responsibilities.   We use security techniques designed to protect our customers’ information when used by employees and business partners to fulfill customer services.   We release information to third parties only with the customers’ consent or request, or when required to do so by law or other regulatory authority.   We may, however, utilize information concerning the principle and obligee in collecting certain debts owed to the company, or other actions brought against the company.   Further, when a court order or subpoena requires us to release information, we will attempt to notify you promptly to give you an opportunity to exercise your legal rights.   The exception to this policy is when we are prohibited by court order or law from notifying you, such as in cases where fraud and/or criminal activity is suspected.

    BIS will continually update its security programs as provided by the vendor in order to further protect our users’ privacy.   It is your responsibility, however, to make your clients aware that information pertaining to them may be accessed by you over the internet.   Again, while transmitting information over a Secure Socket Layer is a reliable and safe way to transmit the information, there is no absolute guarantee of privacy.   However, BIS will continue to update its privacy systems to best serve you and your clients.
  10. Survivability

    If any provision in this terms and conditions of use is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect.   This agreement and all actions contemplated by this agreement shall be governed by the laws of the United States of America, State of California, and any action brought to enforce the terms of this agreement shall be venued in the County of Orange, State of California, as if the agreement was a contract wholly entered into and wholly performed within the County of Orange, State of California.
  11. Violation of Terms and Conditions of Use

    BIS reserves the right to seek any and all remedies available at law or in equity for violation of these terms and conditions of use, including but not limited to, the right to block access from a particular internet address to the site.
  12. Changes to Rules and Regulations

    BIS reserves the right to revise the terms and conditions of use at any time and users are deemed to be apprized of and bound by any such changes.   BIS further reserves the right to modify or delete this site at any time, at BIS’s sole discretion.
  13. Reservation of Rights

    Any rights not expressly granted herein are reserved
